Blondell & Associates (now Blondell, Miller & Schuler) successfully pursued the first occupational disease claim in Maryland for PTSD (without any physical injury). The case of Means v. Prior to this case being decided, PTSD could only stand alone as a claim if caused by a specific event. This case recognized that PTSD could occur as a result of a series of events over time and be slow and insidious in its onset; just like other occupation diseases.
Of course, PTSD can also be caused by one traumatic event such as being a victim of an armed robbery while on the job. An accidental injury claim could be made for PTSD in this type of situation.
